Bu Kullanım Sözleşmesi ("Sözleşme"); bir tarafta [Ticari unvan] ("Gulet Alışveriş", "Platform" veya "biz") ile diğer tarafta Platform'a erişen ve/veya Platform'u kullanan gerçek veya tüzel kişi ("Kullanıcı" veya "siz") arasında akdedilmiştir.

Platform'a erişerek, hesap oluşturarak veya Platform'u herhangi bir şekilde kullanarak bu Sözleşme'yi, Gizlilik Sözleşmesi'ni ve varsa Reklam ve Pazarlama Sözleşmesi'ni okuduğunuzu, anladığınızı ve kabul ettiğinizi beyan edersiniz. Şartları kabul etmiyorsanız Platform'u kullanmamalısınız.

Sözleşme; web sitesi, ilerleyen dönemde sunulabilecek mobil uygulamalar ve bunlara bağlı tüm alt hizmetleri kapsar.

This Terms of Use Agreement (the "Agreement") is concluded between [Legal entity] ("Gulet Alışveriş", the "Platform" or "we") and any natural or legal person accessing and/or using the Platform (the "User" or "you").

By accessing the Platform, creating an account, or using the Platform in any way, you confirm that you have read, understood and accepted this Agreement, the Privacy Agreement and, where applicable, the Marketing Consent Agreement. If you do not accept these terms, you must not use the Platform.

The Agreement covers the website, any mobile applications that may be offered in the future, and all related sub-services.

Platform; gulet ve ticari teknelerin kumanya/tedarik süreçlerini dijitalleştiren bir yazılım ve aracılık hizmetidir. Kaptanlar misafir sayısına göre liste oluşturur, listeler ilgili tedarikçilere iletilir, alışveriş görevlileri siparişi hazırlar ve teslim eder.

Platform bir market, bakkal veya perakende satıcı değildir; ürünlerin satıcısı, mülkiyeti ve ayıptan doğan sorumluluğu ilgili tedarikçiye aittir. Platform, sipariş edilen ürünlerin fiyatını, kalitesini, stok durumunu veya teslim süresini taahhüt etmez.

The Platform is a software and intermediation service that digitalises provisioning for gulets and commercial yachts. Captains build lists based on guest count, the lists are delivered to the relevant suppliers, and shoppers prepare and deliver the order.

The Platform is not a grocery store or retailer; the seller, owner and warranty obligor of the goods is the relevant supplier. The Platform makes no commitment as to the price, quality, availability or delivery time of ordered goods.

Platform'u yalnızca yürürlükteki mevzuata, bu Sözleşme'ye ve dürüstlük kuralına uygun şekilde kullanabilirsiniz. Kullanıcı:

• Girdiği bilgilerin doğru, güncel ve kendisine ait/yetkili olduğu bilgiler olduğunu,
• Platform üzerinden paylaştığı üçüncü kişi verileri (ör. tedarikçi telefonu, misafir bilgisi) bakımından gerekli hukuki dayanağa sahip olduğunu,
• Platform'u yalnızca tekne tedarik süreçlerinin yönetimi amacıyla kullanacağını,
• Hizmeti üçüncü kişilere devretmeyeceğini veya yeniden satmayacağını

kabul ve taahhüt eder.

You may use the Platform only in compliance with applicable law, this Agreement and the principle of good faith. The User undertakes that:

• the information entered is accurate, current and belongs to them or is entered with authority;
• they have a valid legal basis for any third-party data shared through the Platform (e.g. supplier phone numbers, guest details);
• the Platform will be used solely to manage vessel provisioning processes;
• the service will not be transferred or resold to third parties.

Aşağıdaki fiiller kesinlikle yasaktır ve hesabın derhal askıya alınması/feshi sonucunu doğurabilir:

• Yetkisiz erişim, şifre kırma, güvenlik testi niteliğinde izinsiz tarama, sızma girişimi;
• Otomatik betik/bot ile aşırı istek gönderme, hizmeti yavaşlatma veya erişilemez kılma (DoS/DDoS) girişimleri;
• Kaynak kodun izinsiz kopyalanması, tersine mühendislik, türev çalışma üretimi;
• Başkasına ait hesabın izinsiz kullanımı veya kimlik taklidi;
• Hukuka aykırı, yanıltıcı, hakaret içeren, ayrımcı veya üçüncü kişi haklarını ihlal eden içerik girilmesi;
• Zararlı yazılım, virüs veya kötü amaçlı kod yüklenmesi/iletilmesi;
• İstenmeyen toplu ileti (spam) gönderimi için Platform verilerinin kullanılması;
• Platform üzerinden elde edilen tedarikçi/kullanıcı bilgilerinin izinsiz olarak toplanması, kazınması (scraping) veya üçüncü kişilere satılması;
• Kaçakçılık, yasa dışı ürün tedariki veya mevzuata aykırı herhangi bir faaliyetin planlanması.

İhlal tespiti hâlinde Platform; içeriği kaldırma, erişimi kısıtlama, hesabı askıya alma veya feshetme ve gerekli hâllerde yetkili makamlara bildirimde bulunma hakkını saklı tutar.

The following are strictly prohibited and may result in immediate suspension or termination of the account:

• unauthorised access, passcode cracking, unsanctioned scanning or intrusion attempts;
• excessive automated requests via scripts or bots, or attempts to degrade or deny service (DoS/DDoS);
• unauthorised copying of source code, reverse engineering, or creating derivative works;
• using another person's account without permission, or impersonation;
• entering unlawful, misleading, abusive or discriminatory content, or content infringing third-party rights;
• uploading or transmitting malware, viruses or malicious code;
• using Platform data to send unsolicited bulk messages (spam);
• harvesting, scraping or selling supplier/user information obtained through the Platform;
• planning smuggling, procurement of illegal goods, or any activity contrary to applicable law.

Where a breach is identified, we reserve the right to remove content, restrict access, suspend or terminate the account, and notify the competent authorities where required.

Platform'un yazılımı, arayüz tasarımı, marka, logo ve ürün kataloğu düzeni dâhil tüm fikrî hakları [Ticari unvan]'a aittir. Bu unsurlar izinsiz kopyalanamaz, çoğaltılamaz, dağıtılamaz.

Kullanıcı tarafından girilen İçerik Kullanıcı'ya aittir. Kullanıcı, hizmetin sunulabilmesi (saklama, işleme, ilgili tedarikçiye iletme) amacıyla sınırlı, dünya çapında, telifsiz bir kullanım hakkı verdiğini kabul eder. İçeriğin işlenmesine dair ayrıntılar Gizlilik Sözleşmesi'nde açıklanır.

All intellectual property rights in the Platform — including the software, interface design, brand, logo and catalogue structure — belong to [Legal entity]. These elements may not be copied, reproduced or distributed without permission.

Content entered by the User remains the User's. The User grants a limited, worldwide, royalty-free licence to use that Content solely to provide the service (storing, processing, forwarding to the relevant supplier). Details of processing are set out in the Privacy Agreement.

Platform; barındırma, veritabanı, harita ve mesajlaşma gibi alanlarda üçüncü taraf sağlayıcılar kullanır. Bu sağlayıcıların tam listesi ve veri merkezi lokasyonları Gizlilik Sözleşmesi'nde yer alır.

Tedarikçilerle kurulan alım-satım ilişkisi Kullanıcı ile tedarikçi arasındadır. Ürün bedeli, fatura, iade ve ayıplı mal sorumluluğu ilgili tedarikçiye aittir.

The Platform relies on third-party providers for hosting, database, mapping and messaging. The full list of providers and their data centre locations is set out in the Privacy Agreement.

Any purchase relationship formed with a supplier is between the User and that supplier. Payment, invoicing, returns and liability for defective goods rest with the relevant supplier.

Platform "olduğu gibi" ve "mevcut hâliyle" sunulur. Kesintisiz veya hatasız çalışacağı taahhüt edilmez. Bakım, güncelleme, altyapı sağlayıcı kaynaklı arıza veya mücbir sebep hâllerinde hizmet geçici olarak durabilir.

Platform, özellikleri geliştirme, değiştirme veya kaldırma hakkını saklı tutar. Önemli değişiklikler makul süre önce duyurulur.

The Platform is provided "as is" and "as available". We do not warrant uninterrupted or error-free operation. Service may pause temporarily for maintenance, updates, provider-side incidents or force majeure.

We reserve the right to develop, modify or withdraw features. Material changes will be announced within a reasonable period beforehand.

Yürürlükteki mevzuatın izin verdiği azami ölçüde Platform; dolaylı zararlar, kâr kaybı, veri kaybı, iş kesintisi, sipariş edilen ürünlerin ayıbı, gecikmesi veya teslim edilmemesi ile üçüncü taraf hizmet sağlayıcılardan kaynaklanan kesintilerden sorumlu değildir.

Platform'un kastı veya ağır ihmali hâlleri ile tüketici mevzuatından doğan emredici haklar saklıdır.

Kullanıcı, Platform üzerinden ilettiği listelerin doğruluğunu kontrol etmekle yükümlüdür; yanlış miktar veya eksik ürün girilmesinden doğan sonuçlardan Kullanıcı sorumludur.

To the maximum extent permitted by applicable law, the Platform is not liable for indirect damages, loss of profit, loss of data, business interruption, defects, delays or non-delivery of ordered goods, or outages originating from third-party service providers.

Cases of wilful misconduct or gross negligence, and mandatory consumer-law rights, are reserved.

The User is responsible for checking the accuracy of the lists they submit; the consequences of incorrect quantities or omitted items rest with the User.

Kullanıcı, dilediği zaman Platform'u kullanmayı bırakabilir ve hesabının kapatılmasını talep edebilir. Platform; bu Sözleşme'nin, özellikle Kabul Edilebilir Kullanım Politikası'nın ihlali hâlinde hesabı bildirimli veya ihlalin ağırlığına göre bildirimsiz askıya alabilir ya da feshedebilir.

Fesih hâlinde verilerin saklanması ve silinmesi Gizlilik Sözleşmesi'ndeki saklama sürelerine tabidir.

You may stop using the Platform at any time and request closure of your account. We may suspend or terminate an account — with notice, or without notice where the breach is severe — if this Agreement, and in particular the Acceptable Use Policy, is breached.

Upon termination, retention and deletion of data follow the retention periods set out in the Privacy Agreement.

Bu Sözleşme Türkiye Cumhuriyeti hukukuna tabidir. Uyuşmazlıklarda [Muğla] Mahkemeleri ve İcra Daireleri yetkilidir. Tüketici sıfatını haiz kullanıcılar bakımından Tüketici Hakem Heyetleri ve Tüketici Mahkemeleri'nin yetkisi saklıdır.

This Agreement is governed by the laws of the Republic of Türkiye. The Courts and Execution Offices of [Muğla] shall have jurisdiction. For users qualifying as consumers, the jurisdiction of Consumer Arbitration Committees and Consumer Courts is reserved.

Platform bu Sözleşme'yi güncelleyebilir. Güncel metin bu sayfada yayımlanır ve "son güncelleme" tarihi değiştirilir. Esaslı değişikliklerde uygulama içi bildirim veya e-posta ile bilgilendirme yapılır. Değişiklik sonrası kullanıma devam edilmesi kabul anlamına gelir.

We may update this Agreement. The current text is published on this page with an updated "last updated" date. For material changes we will notify you in-app or by email. Continued use after a change constitutes acceptance.
